Fair Use Policy v1.6

This policy applies to the usage of data connections and SMS from units connected to Nimbus or DIGICHEM Plus online platforms.

• CWC reserves the right to vary the terms of the Fair Use Policy from time to time.
• CWC may rely on this policy if your usage of data connections & SMS is unreasonable.
• Unreasonable use is considered as excessive data connections and/or excessive SMS’s being sent from a unit.

If you are in breach of the Fair Use Policy, CWC may contact you to discuss changing your usage.

If after CWC has contacted you, your unreasonable use continues, CWC reserves the right to (a) limit your use and/or (b) invoice you for reasonable additional charges

 

CWC Technical Tools – Terms and Conditions of Use v1.0

 

 1. Purpose

Convergent Water Controls (CWC) provides software applications, spreadsheets, calculators and other technical tools to assist users with equipment selection, configuration, operation, maintenance and related technical activities. These tools are intended to provide guidance and assistance and do not replace professional judgement or manufacturer instructions.

 

2. Accuracy and Suitability

While reasonable care has been taken to ensure accuracy and reliability, CWC does not guarantee that its tools are free from errors or suitable for all applications.

 

3. User Responsibility

Users are responsible for verifying all calculations, settings, outputs and equipment compatibility before implementation. Tools must be used in accordance with relevant manufacturer instructions, applicable Australian Standards and safety requirements.

 

4. Limitation of Liability

Use of these tools is at the user's own risk. To the extent permitted by Australian law, CWC accepts no liability for loss, damage, equipment failure or associated costs arising from their use.

 

5. Intellectual Property and Distribution

All tools remain the property of CWC unless otherwise stated. Unauthorised modification, reproduction or distribution is not permitted without prior written approval.

 

6. Acceptance

By downloading, accessing or using a CWC technical tool, users acknowledge and agree to these Terms and Conditions.
